DuPage County Illinois Foreclosures

DuPage County Illinois foreclosures are carried out entirely by the
proceedings of the court and the typical time period is one year. The
non-judicial foreclosures are totally excluded by Illinois statutes, and
instead a foreclosure is done by filing a case at court. The lawsuit can
either seek a strict foreclosure or a foreclosure that abides by the Illinois
Mortgage Foreclosure law. The approach made by the Foreclosure law
is found to be more common among DuPage County Illinois foreclosures
than when compared to a strict foreclosure. The foreclosure law in
Illinois, clearly states the terms to be included in the petition filed by the
lender for a foreclosure. In case the lender abides by those terms
properly he can win the petition by motions and will not have to appear
for a trial.

A new procedure called consent foreclosure also exists in DuPage
County Illinois foreclosure which helps in speeding up the judicial
procedure. Through a consent foreclosure all the rights of the borrower
are conferred and title in the lender by clearing all claims (except that of
the Government of United States) including the rights for redemption
reinstatement of a junior lien who failed in objecting and who was joined
properly. In case there is a stop foreclosure by the borrower, wherein
the junior lien holder redeems the property within the time period of
twenty days then the property is handed over to the junior lien. In a
consent foreclosure the final judgment must declaim the waiver of the
rights of the lender for a personal judgment of any kind and can block a
deficient not only against the borrower alone, but also for any
co-borrowers or any other party liable for the mortgage.

A notice is put up in the local newspaper and the first publication will
have a duration of 45 days prior to the date of sale, and the last
publication should not be less than 7 days prior to date of sale. In case
of postponement of the sale, the person who conducts the sale
announces the new sale details and in case the postponement is more
than sixty days, a new notice may have to be issued.

In the case of DuPage county Illinois foreclosures, the judge conducts a
public auction. Everyone including the lender is allowed to bid. The
highest bidder pays the price agreed upon and the judge gives the
highest bidder a certificate upon confirmation from the court.
